NotesThis article examines the complex legal landscape around protection of riparian areas in the Oregon Coast Range. The authors compare four policies: the Northwest Forest Plan, the State Forest Management Plans, Forest Practices Administrative Rules, and the Agricultural Water Quality Management Plans. The difference between plans is vast. One issue, wooded buffer zones around streams, shows a range from 0 (agricultural land) to ~152 meters (fish-bearing streams managed under the Northwest Forest Plan). The authors note that prescriptive standards seem to manage better than outcome-based standards, and suggest that expanding the public trust doctrine might help in developing responsible and reasonable standards.
